This paper aims to discuss elements that lead us to understand the interests that direct capital in the articulation of educational policies and in the offer of Distance Education for Higher Education and Basic Education in recent years and its intensification in times of pandemic. We also seek to demonstrate the main problems and consequences of this organization and training for individuals attending Basic Education and public universities. We expose some existing laws that regulate this modality in Brazil and the referrals given by the Ministry of Education (MEC) since the beginning of the Bolsonaro Government, and we expose the problem of DE in the improvised implementation by State and Municipal Networks in the context of social isolation due to COVID -19. We understand and point out the role of technology in an exceptional situation such as the one we are living in, without losing focus on the mediation and role of the teacher, as well as in the concept of education that is a process of human formation, and therefore cannot be individual, mechanic, centered on a technological fetishism and with the concern with workload and a list of contents.
